Terms of Service — Podświadomość App

1. General Provisions

1.1. The Podświadomość mobile application ("App") is provided by Mietec GmbH, registered in Switzerland under number CHE-364.036.829 ("Operator", "we", "us").

1.2. By using the App you agree to these Terms of Service in full. If you do not agree, please do not use the App.

1.3. The App is available exclusively to users who are 18 years of age or older.

2. What Podświadomość Is

2.1. Podświadomość is a personal reflection and self-development app that offers:

• AI-assisted conversation about dream content and emotions,
• generation of personalized guided meditations,
• creation of power sentences based on dream analysis,
• reflection on physical signals using the Total Biology Dictionary tool.

2.2. The App is a personal development and reflection tool. It is not a medical device, does not provide medical, psychotherapeutic, or diagnostic services, and does not replace consultation with a doctor, psychologist, or any other healthcare professional.

2.3. If you are experiencing a mental health crisis, suicidal thoughts, or serious health problems, please contact a doctor or a crisis helpline immediately.

3. Registration and Account

3.1. Full use of the App requires creating an account (email address and password).

3.2. You are responsible for the security of your password and all actions taken from your account.

3.3. One account per person. Accounts may not be shared or sold.

3.4. You may delete your account at any time in the App settings. Deletion is irreversible and results in the permanent removal of all your data.

4. Subscription and Payments

4.1. The App offers a free trial period of 7 days, after which access to full functionality requires an active subscription.

4.2. Subscriptions are billed on a monthly or annual basis at the price displayed in the App.

4.3. Payments are processed through Google Play (Android) or Apple App Store (iOS). The Operator does not store payment details.

4.4. You may cancel your subscription at any time in your store settings (Google Play / App Store). Cancellation takes effect from the next billing cycle — no refunds are issued for the current period.

4.5. The Operator reserves the right to change pricing with at least 30 days' notice. Active subscribers will be notified by email.

5. Acceptable Use

The following are prohibited:

• using the App for any unlawful purpose,
• submitting content that infringes the rights of third parties,
• attempting to reverse-engineer, copy, or decompile the App's code,
• sharing your account with other persons,
• using the App for commercial purposes without the Operator's written consent.

6. Intellectual Property

6.1. All rights to the App, its interface, texts, graphics, and sounds belong to Mietec GmbH or are used under appropriate licences.

6.2. Content generated by AI (dream analyses, meditations, power sentences) is created based on your input. The Operator makes no claim to content you personally enter (dream descriptions, notes).

6.3. By using the App you grant the Operator a non-exclusive, royalty-free licence to process the content you submit solely for the purpose of providing the service.

7. Disclaimer of Liability

7.1. The App and its content — including AI analyses, dream interpretations, and Total Biology Dictionary content — are for informational and personal reflection purposes only. They do not constitute medical diagnosis, medical advice, or psychotherapy.

7.2. The Total Biology Dictionary is a personal reflection tool, not a method of medical treatment. The Operator is not liable for health decisions made based on App content.

7.3. The Operator is not liable for interruptions in App availability due to infrastructure failures, force majeure, or technical maintenance.

7.4. AI-generated content may contain errors or inaccuracies. Always verify important decisions with a qualified professional.

8. Termination

8.1. You may terminate this agreement at any time by deleting your account.

8.2. The Operator may suspend or delete an account in the event of a material breach of these Terms, without obligation to refund fees for the current subscription period.

9. Governing Law and Disputes

9.1. These Terms are governed by Swiss law.

9.2. Any disputes shall be resolved by the courts of the Operator's registered seat, subject to mandatory consumer protection rights applicable in the User's country of residence.

9.3. Users in the EU have the right to use the Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

10. Final Provisions

10.1. The Operator reserves the right to amend these Terms with at least 14 days' notice by email or in-app notification.
