1. Who We Are

The Podświadomość mobile application ("App") is operated by Mietec GmbH, a company registered in Switzerland under number CHE-364.036.829 ("Operator", "we", "us").

This Privacy Policy explains what personal data we collect, why, on what legal basis, and what rights you have.

The App allows you to describe dreams, moods, emotions, and physical symptoms. This content may constitute health data under Art. 9 GDPR — a special category requiring explicit consent.

Legal basis: Your explicit consent given during first launch (Art. 9(2)(a) GDPR). You may withdraw consent at any time — this results in account deletion and removal of all your data.

2.3 Technical Data

We collect basic technical data (app version, device type) solely to ensure the service works correctly. We do not use cookies or behavioral tracking.

3. Data Processors — Who We Share Data With

We use third-party technology providers and share data only to the extent necessary to deliver the service:

All providers operate under Data Processing Agreements (DPAs) and apply appropriate safeguards for data transfers outside the EEA (Standard Contractual Clauses or equivalent mechanisms).

4. How Long We Keep Your Data

• Account data and content — until you delete your account or the contract ends.
• Backups — deleted within 30 days of account deletion.
• Technical data — maximum 12 months.

5. Your Rights (GDPR)

You have the right to:

• Access — receive a copy of your data
• Rectification — correct inaccurate data
• Erasure — the "right to be forgotten"
• Portability — receive your data in a machine-readable format
• Restriction — limit certain processing
• Withdraw consent — at any time, without affecting the lawfulness of prior processing
• Lodge a complaint — with your supervisory authority (e.g. your national data protection authority, or in Switzerland: FDPIC)

6. Data Security

We use encryption in transit (TLS) and at rest. Access to data is limited to the minimum necessary for the service to function. We regularly update our security measures.

7. Children

The App is intended exclusively for users who are 18 years of age or older. We do not knowingly collect data from anyone under 18. If you believe a child is using the App, contact us and we will delete the account promptly.

8. Changes to This Policy

We will notify you of any significant changes by email or in-app notification at least 14 days in advance. Continued use of the App after that period constitutes acceptance of the changes.

9. Governing Law

This Policy is governed by Swiss law (nFADP) with due regard to GDPR requirements for users in the European Economic Area.
